Poland - father has been sentenced to jail for uploading an arguable picture of his son on Facebook

In a precedent case in Poland, father has been found guilty after uploading his son’s picture online. Long story short, it was like this: four years ago, a man took a picture of his then two-years old child, depicting the boy naked and, as weird as it sounds, with a bell in one hand and a bottle of beer in the other. Boy’s mother did not took kindly to that and reported her husband (probably an ex-husband by now) to the police. At first, judge acquited the man, arguing that, at the time, he had complete parental rights. Mother made an appeal and, together with prosecutor’s office and a new lawyer, managed to get the man sentenced for half year of jail as well as community service, a sentence that was later reduced to three months of jail. Judge’s new decision was based on an argument that taking and uploading such photography required the consensus of both parents.

What is the moral of this story? Don’t just publish whatever you like on Facebook. Lots of people, not only your closest friends and family, can see what is there. Also, do not take naked pics of your two-years old, especially when he is holding alcoholic beverage.
