Danish court decided that Apple has to exchange broken phone for a new one instead of refurbished

Citizen of Denmark, one David Lysgaard, sent his broken iPhone 4 back to Apple and, as recompensation, received a refurbished model. Case went into court, which decided that Lysgaard should receive a new model. Court’s argumentation is that exchanging an owner’s item with a refurbished one is not with accordance with Danish law. Judge has decided that refurbished item may contain used parts (well, duh) which decrease the item’s resell value. Apple disagrees with the court’s ruling, stating that refurbished phones are subjected to the same kind of rigoristic testing and quality control as new ones do. Apple can appeal to the higher instance court.
